Initially I would’ve said no, probably not. But after quite a bit of searching I think there might be. I can’t post the screenshot of the information I found, but I’ll try to copy word for word the how to determine if a drink has this tax: —————————————————— Step one: Does the beverage have at least 2 calories per ounce? If no, then the tax does not apply. If yes, proceed to step 2. Step 2: Does the beverage have an added caloric sweetener (ACS)? If no, then the tax does not apply. (For example, 100% apple juice doesn’t have the tax because it has no added sweeteners.) If yes, then the tax is likely to apply. —————————————————— So I would assume yes based off this, because it DOES have artificial added sweeteners. But nothing I could find confirms it 100%. I’m sorry I couldn’t give a clear answer, but hopefully this helps at least a little.

Nope! However, it tastes best when refrigerated. And that’s just a personal opinion. :)
